Commentary by Attorney Michael Grossman

The most up to date images of this intersection I’ve found show narrow residential roads. In areas like this, commercial truck drivers should be at their most attentive, because it’s reasonable they’re going to encounter pedestrians, kids, cyclists, vehicles pulling out of driveways, etc. The question is if the truck driver here did so.

To be clear, this goes both ways. If evidence shows that the accident just wasn’t avoidable, it would be ridiculous to hold a driver accountable for that. But if investigations instead show that an attentive driver could have avoided a collision, it would call for serious investigations into what this driver was doing and why. It’s not just about seeing accountability for an accident; it’s about making sure this sort of thing doesn’t happen again.
