Commentary by Attorney Michael Grossman
This early in the morning, it’s important to ensure a deadly crash gets close attention and thorough investigations. It would surprise folks how often authorities handling accidents like this ended up missing crucial details because officers weren’t given the time or equipment they needed to do their jobs properly. As such, asking key questions can help reveal if authorities can provide any clear answers.
Was the construction zone clearly marked? Was it poorly lit? Was the backhoe protruding into lanes of travel? Did authorities search the area for cameras? Did they pull cellphone data and information from the victim’s vehicle? Were there any witnesses authorities were able to follow up with? Has the vehicle been inspected for potential defects?
If authorities can provide satisfactory answers, that’s generally a good sign they’re being thorough in their investigations. But if the answers come up short—or don’t come at all—then the crash may need attention from more thorough independent accident reconstructionists.
