Montgomery County, TX — August 8, 2024, Benigno Jurado Quinteros was killed as the result of a work accident at around 10:10 a.m. along the North Freeway.

The Occupational Safety and Health Administration reported that the incident happened just south of New Waverly near 18390 Interstate 45 N.

The investigation summary says that 52-year-old Benigno Jurado Quinteros was working to change tires on a trailer along the side of the freeway. Quinteros was underneath the trailer at the time when the jack holding it up reportedly slipped. The trailer landed on Quinteros as a result, ultimately resulting in his death.

In addition to finding out what all led up to the accident itself, there’s also the matter of learning what comes next for the victim’s loved ones. Texas happens to have the most complex work fatality laws of any other state in the country. Despite what many think, there isn’t always some automatic process for getting a family benefits following an accident. That means a lot of families end up at the mercy of their loved one’s employer, who often don’t prioritize the needs of the victim’s family.

Seeing a fair conclusion, then, often requires steps to gather evidence, utilize unique legal strategy, and balance the scales so there can be a just outcome. These OSHA investigations aren’t likely to provide much more than a basic summary of events, which is why I have to wonder what steps have been taken to dig further into the details surrounding this fatal accident.
