Commentary by Attorney Michael Grossman
When an ATV rider swerves off the road and strikes a tree, it’s tempting to call it a simple overcorrection—but that overlooks the critical question of what led to the swerve in the first place. Was the rider reacting to unsafe behavior? Or was there a problem with the machine itself?
1. Did the authorities thoroughly investigate the crash?
In cases where evasive maneuvers are reported, investigators need to determine exactly where and how the rider attempted to avoid the other vehicle. That includes reviewing tire marks, eyewitness accounts, and the layout of the scene. If those steps weren’t taken, we’re left guessing whether the swerve was necessary or whether the ATV lost control independently.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
ATVs are sensitive to handling and stability, especially at speed. If the Honda had issues with steering alignment, braking, or throttle response, that could have turned a simple evasive move into a crash. Unless the ATV is inspected post-crash, those potential failures remain unexamined.
3. Has all the electronic data relating to the crash been collected?
Although many ATVs don’t carry onboard crash data, other sources like surveillance video, helmet cams, or dashcams from nearby vehicles might have captured critical moments. That kind of footage can confirm whether another vehicle forced the swerve and help establish fault. If no such data is reviewed, an important piece of the puzzle may be missing.
Single-vehicle crashes often point to more than just a driver’s reaction—they demand a closer look at what triggered that reaction and whether the machine gave them a fair chance to recover.
Takeaways:
- Evasive maneuvers need to be documented with physical and witness evidence to confirm what actually happened.
- ATV handling issues should be investigated to determine if mechanical failure played a role.
- Crash-related video or electronic data can help establish whether another vehicle was involved and how the rider responded.
