Commentary by Attorney Michael Grossman
After pedestrian accidents, people think the only thing that matters is if the pedestrian was in a crosswalk. The reality is there has to be a careful reconstruction to determine how reasonably avoidable the pedestrian was. If they were in a position where an attentive driver could reasonable avoid hitting them, a driver failing to do so raises serious red flags. But if the pedestrian wasn’t clearly visible or otherwise avoidable, it would be ludicrous to hold a driver responsible for that. So what does the evidence say about how things played out here?
