Commentary by Attorney Michael Grossman
Looking at where this happened (if the images I’m seeing online are up-to-date), it seems like any vehicle turning out of the gas station here would have to yield to highway traffic. That raises serious red flags about why this truck made the turn and why the truck driver thought they could so safely. I certainly don’t want to speculate, so instead this is a good opportunity to reemphasize just important it is to secure clear evidence.
For example, did this travel stop have cameras with a view of the road? If so, securing that evidence quickly would be crucial. It could be vital for piecing together things like visibility, timing, vehicle speed, and other important details that no doubt factored into the crash. Security video is often overwritten or deleted, though, so preserving it early on is crucial.
As obvious a piece of evidence as that may seem to be, it wouldn’t be the first time if authorities let time-sensitive evidence slip through the cracks. That’s why it helps to follow up with authorities early on after a deadly truck wreck like this. If there are any shortcomings in the official investigations, those need to be addressed as early as possible while evidence is still intact. The more facts the victims and families have telling their story, the more likely it is they get a just resolution.
