Commentary by Attorney Michael Grossman
Right now, details suggest that authorities suspect alcohol as a factor in the accident. I can’t confirm anything further about the accident, but alcohol just about always makes investigations into these accidents more complex. That’s because many such accidents involve negligent alcohol providers, and they, too, need to be investigated.
Simply put, alcohol providers in Texas can be in serious trouble when they illegally over-serve someone who is obviously intoxicated. It can result in criminal investigations, fines, license suspensions, or liability if it leads to people getting hurt. But I’ve handled hundreds of those kinds of cases, and authorities frankly tend to let those details slip through the cracks. Their priorities tend to focus solely on charging a driver rather than getting the victims and families actual answers about what legal avenues may apply to their situation. Perhaps they’ve been more thorough here, but it’s not something I would ever take for granted.
