Commentary by Attorney Michael Grossman

If the allegations here are true, people may be too quick to assume the alleged drunk driver will face charges, and that’s the end of it. In reality, there could be an accomplice to all of this who has yet to be called out: a negligent alcohol provider. Allow me to explain.

In Texas, bars and other alcohol providers can face consequences if they over-serve someone who is obviously intoxicated. These consequences can include criminal charges, fines, suspended licenses, or liability for the injuries victims suffer due to that intoxication. In my experience handling hundreds of alcohol-related accident cases, these legal avenues can be crucial for getting otherwise reckless establishments to clean up their act so they don’t continue putting lives at risk.

Unfortunately, authorities don’t often extend their investigations beyond the accident scene. They may be quick to charge an alleged drunk driver, but then they tend to just move on. That’s why a lot of negligent alcohol providers only end up facing consequences when victims and families demand their be further steps taken to see all parties who wronged them held accountable. It wouldn’t be unusual if similar steps were required here.
