Commentary by Attorney Michael Grossman

Any fatal accident is going to bring its own unique challenges to overcome. However, Texas has uniquely challenging work fatality law, and it’s important to understand why OSHA is not the end-all-be-all of how to resolve things.

At the end of the day, families are not always guaranteed benefits or answers after a worker dies on the job. Sometimes, the burden falls to them to seek out the paths available to them and to navigate that legal maze. OSHA can be an important part of that process, but it’s still just one part. So if steps were taken here to arm the worker’s loved ones with the right evidence and tools to explore their options, that would be good to hear. It’s just not something anyone should take for granted.
