Mesquite, TX — June 17, 2025, Andres Diaz-Gil and Efrain Marcial were killed as the result of a work accident along East Scyene Road.

People often move on when they OSHA is taking steps to issue citations and recommend penalties against an employer. The reality is that OSHA’s efforts rarely do enough on their own to actually get families a proper conclusion.

Simply put, Texas has the most complex work fatality laws of any other state in the country. There is not always a guarantee that a families will automatically receive benefits after an accident. Sometimes, it’s up to them to have the evidence and the legal tools necessary to navigate a legal maze and get an employer to do right by the worker’s family.

No matter how severe OSHA penalties may seem, that only serves to punish mistakes from an employer. They don’t work toward getting a family the help they need. That’s why, even if the allegations in these statements prove to be true, there’s likely more to the story that still needs attention.
