San Marcos, TX — May 15, 2025, six pedestrians were injured following an alleged intoxicated driving accident at 1:00 a.m. on Hopkins Street.

Preliminary information from officials says that the collision occurred in a crosswalk at the intersection of Hopkins Street and LBJ Drive in Downtown San Marcos.

According to investigators, six people were in the crosswalk at the time when a vehicle going northbound on LBJ Drive reportedly struck the pedestrians. Due to this, all six pedestrians went to the hospital, though their injuries apparently were not serious.

The driver was reportedly arrested on several counts including intoxication assault and aggravated assault with a deadly weapon. The incident remains under investigation.

When people see situations like this, they may be quick to write the whole situation off as open-and-shut. In reality, there could still be more to this story than even authorities know. For instance, with intoxicated driving allegedly being a factor here, was the driver unlawfully over-served by a bar?

In Texas, alcohol providers can be responsible for contributing to serious accidents. If evidence shows they unlawfully over-served someone who was obviously intoxicated, and it leads to people being hurt or killed, those establishments can face consequences just as intoxicated drivers do.

In my experience, though, authorities tend to move on once they have someone to blame. I can’t count how many times we found a negligent alcohol provider and held them accountable when the authorities were more than content solely holding an intoxicated driver accountable. Maybe authorities are being more thorough here to get the whole story, but it’s something to keep in mind as investigations continue.
