Commentary by Attorney Michael Grossman

While there isn’t a lot of information available right now, a truck driver potentially being under the influence is a huge red flag. Even if charges are filed, though, that may not be the end of this story.

Something to consider anytime a commercial driver is found to be under the inlfuence is whether or not that was known or foreseeable. I’ve handled hundreds of commercial vehicle accidents over the years. In my experience, drivers don’t just get up one day and decide to drink or do drugs before or during work. More often, there is a pattern of behavior that any halfway responsible employer would be able to catch.

So when a truck driver gets behind the wheel impaired, investigators need to find out if the employer knew or should have known about that. If so, then that could mean there’s a negligent employer who also needs to face appropriate consequences and needs to clean up their act before more people get hurt.

Investigations here are still in the early stages, but if authorities don’t extend their efforts beyond the accident scene, they may be missing something important.
