Commentary by Attorney Michael Grossman
When I read about situations like this, one of the most important questions that comes to mind is: Where did the alleged drunk driver get their alcohol? It’s a question that often goes unasked, especially when there’s a clear driver at fault. But Texas law recognizes that sometimes, accountability extends beyond the roadway.
If the driver in this case was indeed under the influence, it’s worth considering whether a bar, restaurant, or other alcohol provider may have played a role—particularly if that provider continued to serve someone who was already obviously intoxicated. Under Texas law, such conduct is not only dangerous, but it also exposes alcohol providers to legal consequences. But the only way to uncover that part of the story is through a thorough investigation, and that doesn’t always happen automatically.
Just because authorities recommend DWI charges doesn’t mean the case is closed. Texas law provides tools to examine whether others contributed to the danger in ways that could have been prevented. That second layer of accountability can make all the difference, especially for those seeking a fuller understanding of what happened and why.
Key Takeaways:
- The law in Texas can hold alcohol providers accountable if they serve someone who is obviously intoxicated and that person causes harm.
- Investigating where the alcohol came from can reveal whether a business shares in the responsibility.
- DWI charges are one piece of the puzzle; a complete investigation may uncover preventable overservice behind the crash.
