How Did This Accident Occur?
If claims made by authorities are true, then it would seem alcohol is the clear culprit here. But that isn’t always as straight-forward as it may sound. I haven’t seen authorities mention if they investigated where the alleged drunk driver was drinking. It’s possible that “how” this accident happened extends beyond just the alleged drunk driver’s actions alone.
For example, if a driver is intoxicated after a bar or restaurant unlawfully over-serves them, the alcohol provider may also be responsible for contributing to the accident. It’s illegal in Texas to serve people who are obviously intoxicated and a clear danger to themselves and others. Still, many alcohol providers ignore these rules for their own benefit, which is why our legislature provided avenues through which to see those negligent establishments held accountable.
I’ve been talking about hold alcohol providers accountable for 30 years now, and I still speak to plenty of folks who never even knew it was something to consider. That’s likely because it’s something authorities rarely take the time to call out. It’s possible authorities here have been more thorough and extended their investigations to include the possibility there’s an accomplice to this accident. But if the investigations began and ended at the crash scene, there might still be more to this story.
