Commentary by Attorney Michael Grossman

If these allegations are true, and authorities are even conducting investigations into a bar that may have played a role in this crash, that’s a very good sign the investigations are being taken seriously.

I’ve handled hundreds of cases against negligent alcohol providers who unlawfully over-served someone who went on to cause an accident. More often than not, we’re the only ones going after those negligent establishments. In fact, when there are criminal or administrative investigations, it’s often because we hand over the evidence we’ve found directly to the authorities. Authorities tend to get so caught up in charging a driver that they overlook Texas law which says negligent bars and similar establishments can also be held responsible for contributing to a serious accident.

These kinds of investigations are important not just for victims and families but also the community as a whole. Whether it’s through criminal charges, civil liability, or administrative penalties, alcohol providers tend to clean up their act once they actually face appropriate consequences. Hopefully the authorities are taking their investigations seriously and not simply treating all of this as a begrudging obligation to rush through. It’s important that if more than one wrongdoer contributed to this accident that all those responsible answer for their actions.
