Commentary by Attorney Michael Grossman

If these allegations are true, it aligns with my experience seeing hit-and-runs where the person who flees typically has something beyond just the accident to avoid responsibility for. Authorities alleging drunk driving here seems like a strong candidate for that. But even if all of these charges go through the courts, that may not be the end of the story.

Alcohol specifically raises the additional challenge of finding out if the alleged drunk driver was unlawfully over-served. In Texas, bars, restaurants, stores, and other establishments can be responsible if they served someone who was obviously intoxicated, and that intoxication led to people getting hurt or killed. If all of the investigations solely focus on the driver’s actions, they might be letting an accomplice ride off into the sunset without answering for their own actions.

I’d emphasize the importance of looking into this after any serious accident. With a kid being seriously hurt, though, that only makes me more keen to know if steps are being taken here to see accountability for all whose actions led to the accident.
