Commentary by Attorney Michael Grossman

Something I see over and over again is single-vehicle accidents not getting the careful attention they deserve. Investigators and the public are often quick to drop fault in the driver’s lap and move on, but decades in my field have taught me that many crashes aren’t as clear-cut as they may seem.

Take the crash in Waco: Investigators mentioned a hunch that driver distraction was a main factor in the car going off-course. Is that possible? Of course; distraction is increasingly a problem on Texas roads. Could there be more to the story that only a more careful investigation would uncover? Absolutely. For one thing, the cause of a crash and the cause of a victim’s injuries aren’t always the same thing. Did the car’s safety features engage correctly when it crashed? Did the seat belt pretensioners fire? Did the airbags fully and promptly inflate? Did the seats stay bolted in place? If the passenger avoided worse injury than the driver, what was different for them?

That’s only a few of the many questions that comprehensive investigation might better answers. If the victim isn’t satisfied with a report that suspects her of getting distracted, and feels there’s more to the story of both how she crashed and how she was hurt, then I hope someone will listen to her and help find all the facts.
