Commentary by Attorney Michael Grossman

It’s challenging enough to make sure a fatal work accident gets a proper, thorough investigation. On top of that, though, Texas has the most complex work fatality laws of any other state in the country. Despite what many think, there isn’t always an automatic process for getting a worker’s family benefits. That means if they don’t have the right evidence, tools, and legal strategy on their side, they may be left at the mercy of an employer who isn’t likely to keep the family’s best interests in mind.

That’s why I have to hope more has been done for this situation than a simple preliminary OSHA report. In my experience, the information the public is seeing here likely barely scratches the surface.
