Commentary by Attorney Michael Grossman
People might assume that since there are alleged violations and recommended penalties here that this whole thing is being handled. However, OSHA looking out for their own priorities doesn’t often help families with their own needs. I’ve been handling fatal work accident cases for over 30 years, and families are often still left with unanswered questions even while OSHA is already issuing fines.
The fact of the matter is Texas has the most complex work fatality laws of any other state in the country. That legal maze takes significant evidence and effective legal tools and strategies to navigate. If a family relies solely on OSHA, they’re more likely to find themselves with incomplete information at a time when they most need evidence.
So, it could be that officials were more thorough here behind the scenes to get answers for the family. That’s just not something I’d ever recommend taking for granted. Work accidents generally need someone working with the family’s best interests as their number one priority. It’s unclear if anyone’s taken those steps here.
