Considering A Dram Shop Lawsuit Against Bar Louie? Here's What You Should Know
My firm has sued more bars for negligent over-service than anyone else in Texas. Over our nearly 30 years of practice, we've seen firsthand just how widespread and serious a problem the failure of bars and restaurants to follow the law seems to be. But given that the general public may understandably not have the same level of awareness, I like to do what I can to bring to their attention. As part of that initiative, I occasionally look through the complaint database of the Texas Alcoholic Beverage Commission and relay my findings to my readers. Bar Louie is an Addison-based bar chain, primarily located in malls and hotels, that boasts approximately 135 locations. Founded in 1991, the bar has had its issues with the TABC over the last two years, fighting allegations of serving drunk patrons, refilling alcohol bottles, and serving alcohol to minors.
Simply because a Bar Louie location has been investigated, it does not mean that they are a location that displays a pattern of violating TABC code. Conversely, if a location has been investigated and investigators determine that they are not in violation of TABC code, that does not mean that the alleged violation did not take place. At times, sufficient evidence required to prove that either criminal or administrative violations occurred is hard to come by. We are simply reporting the locations that were put on the TABC's radar for one reason or another by concerned citizens and law enforcement agencies.
Bar Louie Has Been Investigated by the TABC
Dallas - 8166 Park Lane Suite C310
Allegations:
On 6/6/2018, it was alleged that this location had engaged in refilling and brand substitution.
TABC investigators looked into the matter and closed the investigation on 8/8/2018 with no further action taken against the club.
15900 La Cantera Parkway Suite
Allegations:
On 06/05/2018, it was alleged by a member of the San Antonio community that this location had served alcohol to a person under the age of 21.
TABC officials closed the case on 6/19/2018 and no criminal or administrative penalties were assessed.
Irving - 360 W Las Colinas Boulevard
Allegations:
On 05/29/2018, it was alleged by a patron that this location had sold alcohol to an intoxicated person.
Investigators from the TABC decided that there was not enough evidence to move forward with the investigation and it was closed on 7/26/2018.
Sugar Land - 16089 City Walk
Allegations:
On 03/07/2018, it was alleged that there was a breach of the peace at this location.
The TABC closed the case on 5/8/2018 after being unable to find sufficient evidence to support the allegation.
Hurst - 1101 Melbourne Road
Allegations:
On 02/28/2018, it was alleged that an intoxicated person was served alcohol.
TABC investigators looked into the matter and closed the investigation on 04/25/2018 without taking any further action against the club.
Hurst - 1101 Melbourne Road Unit
Allegations:
On 11/16/2017, it was alleged that an intoxicated person was served alcohol.
TABC investigators closed the investigation on 01/05/2018 without taking further action against the bar.
Sugar Land - 16089 City Walk
Allegations:
On 11/8/2017, it was alleged by a patron that there was a breach of the peace by an intoxicated person that was sold alcohol.
TABC investigators looked into the matter and closed the case on 12/22/2017.
Arlington - 4001 Bagpiper Way
Allegations:
On 07/20/2017, it was alleged by a law enforcement that this location allowed an intoxicated employee to sell alcohol during prohibited hours.
This complaint did not prompt further investigation, and the case was closed on 09/15/2017.
The Woodlands - 24 Waterway Ave
Allegations:
On 06/02/2017, it was alleged that an intoxicated person was over-served alcohol.
TABC investigators looked into the allegations and closed the case on 7/11/2017 without taking any further action against the club.
Hurst - 1101 Melbourne Road
Allegations:
On 11/30/2016, a member of the Hurst community alleged that this location allowed an intoxicated employee to serve alcohol.
The matter was closed on 12/30/2016 after detectives were unable to find sufficient corroborating evidence to support the allegations.
