How Did This Accident Occur?
It’s tempting to look at this accident—only a single vehicle involved late in the evening—and assume that driver error is the cause. However, I’d caution others from jumping to that conclusion. The fact is, we still know very little about what actually happened. While driver error is statistically a good bet, that does not mean that it is the only possible cause. Over the years, I’ve seen plenty of cases where investigations turn up evidence of underlying causes that might otherwise have flown under the radar.
Hopefully investigators look into the possibility of mechanical malfunction or product defect—such as brake failure or a tire blowout—that could have played a role. On top of that, they should definitely look into why the Kia overturned. Most people don’t realize this, but the rollover tests that car manufacturers are required to pass actually do a terrible job at simulating real world scenarios. I would be extremely interested to know if a design flaw contributed to the fact that the Kia overturned. After all, it’s possible that Mr. Lopez’s injuries would not have been so severe had the vehicle managed to remain safely upright.
Should, for one reason or another, the authorities’ investigation seem to be subpar, a third party investigation can always step in to take up any slack and ensure that all bases are covered. After all, Jose Lopez deserves to have real answers backed by solid evidence, not convenient excuses that do little more than saddle him with possibly unmerited blame.
