How Did This Accident Occur?

Interstates are usually the last place drivers expects to see a pedestrian, but that doesn’t that drivers shouldn’t be alert for such hazards.

Investigators likely will consider whether the SUV driver was distracted at the time of the crash and if the pedestrian was on the shoulder or an active traffic lane, but I’m less certain that they will examine the Suburban to see if it had any software issues that could have contributed to the crash, such as a glitch in its lane departure warning system.

The most important lesson I’ve learned in my years as a personal injury attorney is considering every possibility, no matter how remote, is the best way to figure out how a crash happened. The pedestrian’s family deserves that kind of clarity after this accident.
