Commentary by Attorney Michael Grossman

I’m always cautious when I see reports blaming a crash on bad weather. Without a doubt, bad weather conditions can play a role in vehicles colliding. However, that sometimes prevents authorities from taking the time to do a proper accident reconstruction. They just chalk everything up to the weather and move on. Meanwhile, a proper investigation would look at road design, vehicle defects, lighting and signage, vehicle speed, airbags and seatbelts, and all kinds of other potential factors. Weather conditions should be considered with those other possible factors, not in lieu of. Given that someone so young lost their life here, I hope investigators are looking into all possible factors here and not treating things as open-and-shut before they’ve actually looked into all of the evidence.
