With authorities recommending charges here, this all may seem pretty open-and-shut. However, there could be more to this situation than just an alleged drunk driver. There may have been an accomplice who needs to be held accountable: a negligent alcohol provider. Let me explain.
Under Texas dram shop law, bars, restaurants, liquor stores, and other establishments can be held responsible for contributing to drunk driving wrecks. If evidence shows a provider over-served someone who was obviously intoxicated, the establishment can face consequences when that intoxication injuries or kills people. If this is anyone’s first time hearing about this area of Texas law, that sadly isn’t surprising.
Authorities rarely talk about negligent alcohol providers. Most of the time, authorities just move on after charging the alleged drunk drivers. In fact, our independent investigations into drunk driving accidents have often led to negligent alcohol providers not only being held responsible for their role in someone’s serious injuries but also facing criminal investigations and administrative penalties.
All said and done, it’s possible the circumstances leading to this particular accident trace back to a single reckless individual deciding to get behind the wheel drunk. However, it’s up to the evidence to say who and what caused the accident. If there’s a chance that an outside party contributed to the accident, they shouldn’t be allowed to ride off into the sunset without answering for their actions. Texas dram shop law is just one potential path to help ensure all responsible parties are held accountable.
