Commentary by Attorney Michael Grossman

With pedestrian accidents, people sometimes think everything comes down to right-of-way and if the victim was in a crosswalk. That’s obviously important—I wouldn’t suggest otherwise. However, there may still be extenuating circumstances that investigators need to consider. Lighting, road design, signage or signals, alcohol, distraction, medical conditions—these can all play a significant role in an accident like this. If authorities only focus on right-of-way, they could miss a far more serious factor that needs to be addressed. Hopefully this accident got the full attention it deserved.
