Commentary by Attorney Michael Grossman

People tend to only think of crashes in terms of “this driver versus that driver.” But when a passenger is the one most severely impacted, it can make things quite a bit more complex. This is because the law wants to know the actions of all parties involved in a crash. That means if it’s one driver, both drivers, or some outside party (like the manufacturer of a defective airbag, for example), responsibility will generally be placed where it should be. Of course, that’s so long as all the evidence is preserved and allowed to speak for itself. Have those steps been taken here?
