Commentary by Attorney Michael Grossman
When a single-vehicle crash like this occurs, it’s important to make sure the investigation is thorough and considers all possible factors. Accidents like this can be more complex than they appear, and understanding what happened requires asking some key questions.
First, did authorities have the time, tools, and training needed to investigate the crash properly? A vehicle losing control could stem from road conditions, poor visibility, or even sudden maneuvers to avoid an obstacle. Did investigators examine the scene in detail, documenting tire marks, points of impact, and any debris or hazards that might have contributed? Were factors like lighting, weather, and road design evaluated? Without a comprehensive investigation, important details could go unnoticed, leaving significant questions unanswered.
Second, could a vehicle defect have contributed to the crash or its severity? Mechanical issues such as brake or steering malfunctions, tire blowouts, or accelerator problems might explain why the driver lost control. Beyond that, failures in safety systems—like seatbelts that don’t properly restrain or airbags that fail to deploy—can make the consequences of a crash much worse. A forensic examination of the vehicle is essential to uncover any potential defects, but this step often falls outside the scope of routine investigations by authorities.
Finally, was all available electronic evidence preserved? Modern vehicles store critical data in their Engine Control Modules (ECMs), such as speed, braking, and steering inputs leading up to the crash. Additional evidence, like cellphone activity, GPS logs, or video footage from nearby cameras, can provide further insight into the moments before the accident. Acting quickly to secure this evidence is essential to ensure nothing is lost or overwritten.
If authorities can provide clear answers to these questions, it’s likely because they’ve been thorough in their investigations. However, I’ve had hundreds of cases where authorities couldn’t provide clear explanations, so victims and families wanted a second set of eyes looking things over. It remains to be seen what kind of answers are being provided here.
