Commentary by Attorney Michael Grossman

With any serious accident, it’s important to understand how the investigations are being handled. Despite what some think, accidents aren’t always treated as a top priority, which means officers may not have the time or tools they need to do their jobs properly. This can lead to important details slipping through the cracks. That’s why it can be helpful when victims and families are proactive and ask follow-up questions of the authorities.

For example, did authorities look into the possibility of vehicle defects? Things like malfunctioning brakes or steering mechanisms, for example, can unexpectedly cause an accident. On top of that, safety devices can malfunction. If a seatbelt didn’t lock or an airbag failed to deploy, that could make people suffer serious injuries which otherwise could have been prevented.

Another example is asking what kind of electronic evidence authorities secured. This can go beyond things like dash cam footage or cellphone data, which can sometimes also go overlooked. There’s also the Engine Control Modules in the vehicles, which can show things like speed and braking leading up to the crash. Also, nearby businesses or residences may have had security cameras that caught the incident on video. This, too, often goes overlooked.

When families follow up with investigators, they may find that all of their dfoubts and concerns are being addressed adequately. That tends to happen when authorities conduct good, thorough investigations. However, authorities may instead fall short, leaving unanswered questions. That’s when moves can be made to have more thorough independent investigators look into things and find out if authorities missed anything important.
