Commentary by Attorney Michael Grossman
When it comes to pedestrian accidents, folks are often quick to jump to conclusions. They think that it’s all about whether or not the person on foot was in a crosswalk. In reality, the law is nuanced enough that the whole context needs to be considered. What was lighting like? Did the driver have time to slow down? Is there an issue with the design of the road that makes accidents like this common? Was alcohol involved? Did a lack of signage or lighting contribute to the collision? Likely or not, it’s important those who lose a loved one are satisfied they’re getting the complete story. That requires clear, convincing evidence, and it’s not clear right now whether or not authorities took steps to get those answers.
