Commentary by Attorney Michael Grossman
Pedestrian accidents can be complex despite many people thinking the opposite. I’ve heard “Either they were in a crosswalk or they were at fault” more times than I care to count, but every accident—including those with pedestrians—should be carefully investigated and fully understood.
There are still many questions to resolve here: Why was the pedestrian there at the time? Was he walking or running? Where did he come from and where was he headed? How long was he in the road before the car approached? How visible was he? Is that area lit at night? Could the driver not see him? If not, why not? Were both parties alert and paying attention to their surroundings? Did any other vehicles avoid the pedestrian without issue?
I’m not making accusations or saying I know more than reports convey. I’m only saying what I so often do: Even if preliminary reports seem fairly straightforward, it’s always best to evaluate all the possible factors in search of the whole truth. The victim’s loved ones deserve no less.
