Commentary by Attorney Michael Grossman
I haven’t seen authorities say anything about what caused the driver to run the light. Some might not think that really matters—if they ran the light, they ran the light. But at the end of the day, it’s best that people have as much evidence working to tell their side of the story as possible. After all, a police investigation is rarely enough on its own to get an insurance company to cooperate. Backing it up with more facts helps ensure there’s as little room as possible to muddy the waters. Was the driver on their phone? Were they fatigued? Were they drunk on their way home from a bar? Do they have a history of reckless driving? Even if a details seems small, every little bit helps.
