Giddings, TX — November 26, 2024, Victor Barrios Castillo was killed following a work accident at around 9:36 a.m. along Private Road 2191.

Officials with OSHA released a preliminary report, which says the incident happened several miles south of Giddings off County Road 219 and US 77.

According to OSHA, 33-year-old Victor Barrios Castillo was doing roofing work at the time. It appears Victor Barrios Castillo fell through the ceiling, ultimately causing fatal injuries. It appears OSHA issued citations for four alleged “serious” violations. They also recommended a penalty.

It’s always concerning when OSHA alleges there were violations found following an investigation into a worker’s death. However, it’s important people understand why that doesn’t make these situations open-and-shut.

Simply put, Texas has the most complex work fatality accident laws in the whole country. There isn’t always an automatic process for getting a worker’s loved ones benefits or any sort of resolution. Employers are not required to subscribe to the workers’ comp system, and an OSHA investigation prioritizes looking for potential fineable offenses rather than getting a family the answers they need.

As such, OSHA statements like this should be seen more as a piece of the puzzle. If allegations of violations prove to be true, then it can help steer a family’s investigators in the right direction. They can take that path to gather the kind of evidence the family needs for their own purposes to get whatever help and accountability is available to them under Texas law. Hopefully those steps were taken here.
