Commentary by Attorney Michael Grossman

If reports have their facts straight, police seem inclined to chalk this accident up to fatigue. As crash causes go, fatigue doesn’t usually get as much attention as texting or alcohol, but it’s a serious hazard all on its own—so much so that both the state and the federal governments released information about its dangers. So is it possible the accident victim simply nodded off before crashing? Absolutely.

Having said that, though, I’d still argue that a comprehensive investigation is in order. Considering the young man’s injuries, I think it’s best to make sure that all the possible contributing factors are accounted for. Did he actually admit to falling asleep, or did he say just say he was tired? Was anything malfunctioning or defective in the Kia? Weather was reportedly clear and roads were dry, but could something in the road have blown the victim’s tire? Where did he come from before the accident?

The point isn’t to make excuses or overcomplicate things here–just to find the whole truth, including things that the driver in his alleged tired state might not even have realized were happening. If there’s more to say or anything else that contributed to him ending up upside-down against a fence, I’d say he deserves to know about it. Will police take the time and care needed to be sure they have the whole story?
