Commentary by Attorney Michael Grossman
There’s an important question I always keep in mind after serious accidents, and recent years have only brought that issue more to the forefront: Did authorities look into the possibility of a vehicle defect?
To be clear, I am not speculating about this specific crash. Rather, in general, I’ve lost count of how many times a case has come across my desk where authorities were flippant in how they treated a vehicle after a crash.
To make sure no vital evidence is lost, vehicles should be handled with care so specialists can inspect things like the vehicle’s brakes, steering system, airbags, seatbelts, and other safety features. Moreover, these days there are concerns about things like lane assistance, crash avoidance, and other auto-driving systems which are still relatively new and could have issues that aren’t widely known about yet.
This may be just one part of a complete accident reconstruction, but it’s probably the one I see overlooked the most. At the end of the day, a close inspection may simply rule out the possibility of a vehicle defect. Even that, though, can be a significant step forward for victims and families. That’s why I try to shine a light on this important aspect of accident reconstruction whenever possible. Anytime it seems like authorities may be overlooking it, it could be a sign they’re letting important details slip through the cracks.
