Commentary by Attorney Michael Grossman

Anytime authorities mention alcohol as a factor in a crash, folks think that makes things open-and-shut. But that’s rarely true. Alcohol-related accidents can be quite complex, particularly if there was a local alcohol provider who over-served the driver. Those establishments may need to be held accountable just as drunk drivers are.

Simply put, it is unlawful for alcohol providers to serve people who are obviously intoxicated. This potentially exposes an establishment to criminal investigations, administrative penalties, or liability for the injuries caused by the intoxication. Not only is this a potential avenue for getting victims and families much needed help, but it’s also a path for correcting the behavior of negligent alcohol providers so their actions don’t cause harm in the future.

Perhaps authorities here already looked into all of that, but I’m always skeptical of that. I’ve hundreds of cases against negligent alcohol providers. They’re rarely on the police’s radar unless a secondary independent investigation puts them there. I have to wonder if investigations were more thorough than what I’m used to seeing from authorities.
