Commentary by Attorney Michael Grossman
When two 18-wheelers collide on the highway, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.
What caused the trucks to collide? Professional drivers are trained to maintain safe distances, stay in their lanes, and adjust for road conditions, so investigators need to determine what went wrong. Was one driver distracted? Fatigued? Following too closely? Investigators should review dashcam footage, cell phone records, and hours-of-service logs to identify potential causes.
Was speed a factor? Large trucks require significant stopping distance, especially at highway speeds. If one truck was moving too fast for conditions or failed to anticipate slowing traffic, that could have played a role. Investigators should examine black box data, braking distances, and witness statements to determine whether excessive speed contributed to the crash.
Was there a mechanical failure? If a truck’s brakes, steering, or tires malfunctioned, that could have led to a loss of control. Trucking companies are responsible for maintaining their vehicles and ensuring they are roadworthy. Investigators should review inspection records, maintenance logs, and crash scene evidence to determine whether poor vehicle upkeep contributed to the wreck.
Did the trucking companies play a role? Both drivers were operating commercial vehicles, meaning their employers had a responsibility to ensure they were properly trained, well-rested, and following safety protocols. If either driver was inexperienced, under pressure to meet unrealistic deadlines, or operating a poorly maintained truck, investigators need to uncover those details. Reviewing company policies, safety records, and past violations could provide insight into whether broader issues contributed to the crash.
At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
