Commentary by Attorney Michael Grossman

There are a lot of moving parts with this crash, even though authorities have not released many details about what happened. This accident underscores the dangers of towing trailers on busy highways, especially when other vehicles are traveling at high speeds. It also highlights the risks associated with rear-end collisions involving heavily-used rental trucks, which may lack advanced safety features found in modern vehicles.

Was the trailer properly secured? Trailers can be unpredictable if they are improperly loaded, hitched, or maintained. Did the trailer’s movements, such as swaying or sudden braking, contribute to the car’s collision with it?

Did the rental truck driver have enough time to react after the initial collision? Were the truck’s braking systems functioning properly?

All of this means a complicated investigation is facing authorities, who may or may not have the time, training and equipment to sort out what caused this crash. If the official investigation does not answer the lingering questions of those who died in the crash, it may require a second set of eyes on the crash to grant them some closure. Rental trucks are often subjected to heavy use and may not always be well-maintained.

Why did the car catch fire after the second collision? Was it caused by a design flaw, fuel system breach or the force of the crash?

These questions seem like simple ones in a crash like this, but sadly my experience has taught me that authorities don’t always come up with the answers during their investigation.
