Commentary by Attorney Michael Grossman

When crashes like this occur, people might assume they’re the result of simple driver error. However, based on my experience, incidents involving commercial vehicles often reveal deeper issues that require thorough investigation.

One critical factor that investigators should examine in this case is driver fatigue. Operating a commercial vehicle is demanding, and fatigue remains one of the leading contributors to crashes in the trucking industry. Was the driver of the box truck properly rested, or were they pushing through long hours to meet deadlines? Even though federal hours-of-service regulations are in place to limit driving time, they are not always adhered to. Some drivers feel pressured by tight schedules or company expectations to keep going even when they’re too tired to drive safely. Fatigue can impair judgment, delay reaction times, and make it nearly impossible to maintain control of a vehicle in emergency situations, possibly explaining how the truck veered off its lane.

If fatigue played a role, it’s worth considering the responsibility of the trucking company. Were they monitoring the driver’s compliance with hours-of-service rules? Did they create an environment where drivers felt obligated to ignore safety protocols to meet tight deadlines? Companies have a duty to ensure their drivers are well-rested and fit to drive, and neglecting that responsibility can have severe consequences.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
