Commentary by Attorney Michael Grossman
When a truck crashes into a building and injures more than a dozen people, the most immediate question is: What caused the driver to lose control so completely? Events like this don’t happen without a breakdown—whether mechanical, medical, or human—and determining the nature of that failure is the first step toward accountability.
At this stage, it’s unclear whether the truck was making a delivery, turning off the road, or simply passing through the area when the crash occurred. That matters. If the vehicle was in motion on a public road, speed, driver attentiveness, and road conditions will all come under scrutiny. If it was operating off-road—such as in a lot, loading area, or alley—then maneuvering decisions, visibility, and vehicle handling become central.
Investigators will need to determine whether the truck was in proper working order, whether the driver was qualified and alert, and whether external factors like signage or access design contributed to the crash. Data from the truck’s engine control module (black box), surveillance footage, and physical evidence from the scene will be essential to reconstructing what happened.
Given the number of people hurt, the consequences here are widespread. But determining responsibility—whether it rests with the driver, the company, or both—depends entirely on what the evidence shows.
Key Takeaways:
- The cause of the truck’s departure from the roadway and collision with a building remains unknown, but will be central to any legal analysis.
- Investigators will focus on whether the truck was operating safely, and whether mechanical failure, distraction, or other factors played a role.
- Black box data, surveillance footage, and physical evidence from the scene will be essential to understanding what went wrong.
- The number of injuries may indicate a larger operational failure, but that conclusion requires careful investigation.
- Responsibility cannot be assigned until all contributing factors—including vehicle condition, driver conduct, and company oversight—are fully examined.
