Commentary by Attorney Michael Grossman

Whenever I read about a crash where a semi-truck and a smaller vehicle collide, particularly one resulting in the loss of life, I immediately ask what factors led to such an outcome. It’s tempting to assume that the larger vehicle is always at fault, but crashes like this are rarely that straightforward. To truly understand what happened, investigators need to look beyond the crash scene and dig into the events that set it in motion.

One key area to examine is whether the semi-truck driver followed the rules of the road and operated his vehicle safely. Semi-trucks are complex machines requiring professional training and careful handling. Did the driver make an error in judgment, such as failing to yield or misjudging the speed of the pickup? Was he distracted or fatigued? These questions are critical in determining if driver behavior played a role in the collision.

Equally important is the condition of the semi-truck itself. Was the truck properly maintained? Problems like worn brakes or defective tires can make it impossible for even a skilled driver to avoid a collision. Records of the truck’s maintenance and inspection history should be a top priority in the investigation.

On the other hand, it’s also important to scrutinize the pickup driver’s actions and vehicle condition. Was the pickup driver adhering to traffic laws? Were there any mechanical failures or external factors, like visibility or road conditions, that may have contributed? A thorough investigation needs to consider all possibilities.

The crash location on U.S. Highway 136 also raises questions about the role of the road itself. Rural highways like this one often lack features that could mitigate the risk of serious collisions, such as turning lanes, proper signage, or adequate lighting. If the road design contributed to the crash, that’s an issue worth addressing.

In my experience, the most crucial part of any truck accident investigation is gathering all available evidence. Dashcam footage, black box data from the semi-truck and cell phone records can provide valuable insights into what happened in the moments leading up to the crash. Without this level of scrutiny, the full story often remains untold.

As authorities investigate this crash, I hope they leave no stone unturned. For those affected by this loss, understanding the “why” behind the incident is an essential step toward finding closure and ensuring accountability. Crashes like this one remind us of the critical importance of thorough investigations in preventing future tragedies.
