Commentary by Attorney Michael Grossman
With a crash like this, it may be easy to assume driver error led to the truck overturning. First of all, it’s important to consider every possible factor, even unlikely and possibly unavoidable ones. Was there a tire blowout? A medical emergency? Something in the road? And even if something more common like distracted driving or fatigue led to the crash, that wouldn’t necessarily make this open-and-shut.
With commercial vehicle accidents, there can be important details to consider that aren’t necessarily apparent at the crash scene. For example, I’ve handled hundreds of commercial vehicle accident cases, and mistakes from a driver’s employer can lead to accidents like this. Was the driver pressured to meet unreasonable deadlines? Was the truck in need of repairs the company was putting off? Was this driver inexperienced or poorly trained? Have they caused accidents before?
In my experience, families aren’t looking for an easy explanation. They want to know they’re getting all the facts, and they want to see any wrongdoers held accountable for their actions. If authorities just focus on the crash scene itself, they’re bound to overlook crucial details that victims and families need to know. That’s when there has to be consideration for how to pick up the slack and ensure that important information doesn’t slip through the cracks.
