Commentary by Attorney Michael Grossman

With the events described here, and looking at images of the crash scene published in the news, a question immediately comes to mind: What made this truck driver think it was safe to make that turn? To be rather blunt, I’ve handled hundreds of commercial vehicle accident cases, and I can’t recall a time something like this happened without a truck driver doing something wrong.

Was it something as simple as the driver being on their phone or being impatient without looking both ways? Or, could there be more complex issues leading to the wreck? Was the driver rushing to meet an unreasonable deadline set by their employer? Did they misjudge the distance of the approaching victim due to a lack of experience? Are they someone with a history of making mistakes behind the wheel, but their employer ignored or entirely overlooked that history? Was the driver working long hours, leading to fatigue?

Ultimately, there could be an extensive investigation into the events leading up to this, and evidence could show the truck driver had every reason to believe they could make the turn safely. Unusual things happen, and it’s important to investigate potentially unavoidable scenarios. In my experience, though, when safe, responsible truckers turn across highways, people don’t get hurt or killed. What made this situation different?
