Commentary by Attorney Michael Grossman
As straight-forward as all of this may seem, the involvement of an alleged impaired driver here could make this a lot more complex than people may realize. For example, if alcohol was the cause of the crash, it may be important to find out where that alcohol came from.
South Carolina has laws similar to Texas which say that negligent alcohol providers who unlawfully over-serve people who have already had too much can be responsible for contributing to a crash resulting from that intoxication. I’ve handled hundreds of cases against alcohol providers, and the investigations extend far beyond the crash scene itself. Receipts, witness statements, security footage, company training and history—it’s a lot more than a typical police crash investigation.
So while there may be a driver here being blamed for behavior that, if true, is clearly unacceptable, making things right for the victims and families involved may be anything but open-and-shut. It make take a lot more thorough independent investigations to bring the full story to light and ensure there’s accountability for all parties responsible for the crash.
