Commentary by Attorney Michael Grossman
People generally think that finding out who had the right-of-way in a crash would be simple for authorities to determine. The reality, though, is that not all accidents get the attention they need.
I recall a while back handling an accident where two cars crashed at a light. Both drivers blamed the other, and the investigating officers basically just threw up his hands and said, “Y’all sort it out yourselves.” Well, we were brought into the case, and within a couple of days we found security video that showed the other driver run the light and hit our client. That was that.
Seemingly obvious details like that can easily slip through the cracks if authorities are unwilling or unable to prioritize finding the facts. That’s why it’s important to follow up with them early on to see how the investigations are going. If people just wait around and assume authorities are getting the facts, they can easily find themselves weeks or months in the future just as in the dark as they were day one.
