Commentary by Attorney Michael Grossman

One of my main concerns reading about crashes involving teen drivers is whether or not authorities were fair in their investigations. Frankly, a lot of people are just quick to assume teen drivers did something wrong. While they may be statistically more likely to make mistakes, their accidents deserve as much attention as any serious crash. That’s why it can be crucial to ask key questions about the investigations early on.

  • Did investigators have the tools and time to thoroughly document the scene?
If departments are limited in resources, important evidence—like skid marks, vehicle position, and road conditions—can go unrecorded, making it harder to understand what actually happened.
  • Has anyone checked for a possible vehicle defect?
Brake failure, steering issues, or other mechanical problems can cause a sudden loss of control. These kinds of defects often go unnoticed without a detailed inspection.
  • Was the vehicle’s electronic data preserved?
Most modern cars store crash-related data such as speed, braking, and steering inputs. That information, paired with phone records or nearby camera footage, can provide key insight—if it’s secured promptly.

If authorities can answer these questions adequately, it’s usually a sign that they did good, thorough investigations. But if it seems like their answers are coming up short, then there may need to be more thorough independent investigations to ensure all the facts are brought to light.
