Even if the allegations here are true, and even if charges were filed here, there could be more to this story than authorities have said. The fact of the matter is that most of the time following wrong-way car accidents, thorough investigations will show that the wrong-way driver was unlawfully over-served by an alcohol provider. Let me explain why that matters.

One of the reasons wrong-way crashes usually involve drunk drivers is because it’s difficult to get on the wrong side of a major roadway without realizing it. As such, a driver doing so usually means they’re well outside of their right state of mind. That’s not just a bit over the legal limit; more often, it’s a sign someone was extremely intoxicated.

Well, in Texas, bars, restaurants, and other alcohol providers can be responsible if they over-serve someone who then goes on to cause a serious accident. Doing so helps to ensure both that there’s accountability for the harm done to the victims but also so those establishments clean up their act before more people get hurt.

Unfortunately, this is something authorities often overlook. I’ve handled hundreds of intoxicated driver accident cases. Authorities tend to move on once there’s a driver facing charges. To truly ensure there’s accountability, though, any and all accomplices must answer for their actions, as well. So, have investigators looked into where this driver was coming from and how they got onto the wrong side of the road? Or, are they only telling a small part of a larger story?
