Commentary by Attorney Michael Grossman

If police do find alcohol was a factor here, people tend think that makes things open and shut. In fact, it usually makes things more challenging for the victims and families involved. This is because there is often another person involved in the crash who needs to face consequences: a negligent alcohol provider.

Put simply, it’s illegal in Texas to over-serve someone who’s obviously intoxicated. Doing so means an establishment can be liable for injuries resulting from that person’s intoxication. This is important to look into for two main reasons. For one, it’s important victims and families know that all parties who wronged them are held accountable. Two, in my experienced handling hundreds of cases against negligent alcohol providers, they clean up their act once they actually face consequences. That helps ensure they don’t cause any more harm to the community.

Again, that’s something that isn’t confirmed here. It’s simply a possibility that rarely gets the attention it deserves. Hopefully there have been investigations into these possibilities, otherwise those involved here may only be getting part of the larger story they deserve.
