Commentary by Attorney Michael Grossman
A vehicle being on the wrong side of the road raises serious red flags. It’s possible it was just a simple mistake, the result of fatigue, or perhaps even due to poor lighting or signage in this area. However, it’s far more often the result of intoxicated driving. Here’s why a situation like that could present a more challenging situation than people may realize.
I’ve handled hundreds of cases involving intoxicated driving. When someone is on the wrong side of a highway, they’re rarely just barely over the legal limit. More often, they’re extremely intoxicated after being unlawfully over-served by a local bar. That would raise questions not just about a driver’s actions but those of any complicit alcohol providers who broke the law, as well.
Again, authorities have not confirmed alcohol here at the time of writing this. But not only is it the most common cause of wrong-way driving, but also Midland-Odessa happens to be one of the worst areas in the state for drunk driving. Ignoring those red flags would be outright irresponsible. It would be more irresponsible, though, to assume all of the blame begins and ends solely at the crash scene. The victims and families affected here deserve to know that all the problems that led to the crash will get attention.
