Commentary by Attorney Michael Grossman
People are sometimes quick to jump to conclusions when it comes to accidents involving pedestrians. But like any serious accident, it’s important to get the whole story. It’s not all about who had the right-of-way.
What was visibility like? What are road markings and signage like here? Was cell phone usage a factor? Was alcohol? Are there any nearby cameras that may have had a view of the collision? Is this a stretch of road that frequently has pedestrian accidents?
Likely or not, those affected by the accident deserve answers. Those won’t come if people just assume a situation is open-and-shut without actually letting the evidence speak for itself.
