Commentary by Attorney Michael Grossman

Right now, the cause of the crash is not confirmed, but authorities mentioned looking into alcohol. It’s possible that’s just standard procedure, but even if there is evidence that shows alcohol was involved here, it may surprise people when that doesn’t suddenly make investigations open-and-shut. It can lead to further investigations into where that alcohol came from and if the drunk driver was illegally over-served. In Texas, bars and other establishments that serve someone who is obviously intoxicated can be subject to criminal investigations, fines, license suspensions, and even liability for injuries resulting from that investigations. That’s quite a bit more legal maneuvering than just charging someone with a DWI. So if something like that did happen here, experience tells me the road ahead will be anything but straight-forward.
